A: Maybe. If this is a PA claim it would depend on the specific facts surrounding the onset of symptoms including what job related functions you were performing at or around the time your symptoms started. This may be a Federal claim based upon your employer. Federal Workers' Compensation has different rules than PA claims. There are only a handful of lawyers in PA that handle Federal claims, and since I am not one of them, I will not be commenting on whether or not their is a claim under the Federal rules.

A: Generally, one way or another it's either covered by federal workers comp of one flavor or another, or your medical package.

You want to file for the comp and also protect yourself by listing as secondary coverage your health plan.
