Seattle, WA asked in Landlord - Tenant for Colorado

Q: Am I responsible for damages after move out date?

We rented a house in CO for one year, and moved out on May 31 at end of lease. Our lease said we were to have the sprinkler system professionally winterized. We hired a lawn company to do that in Nov 2015. The new tenants turned on the sprinkler system two weeks after we had left, and it leaked into basement. Landlord now wants to take our deposit to cover repairs. It has been less than the 30 days, but there was no damage during move out, and landlord admitted as much. It seems to me we are not responsible for the damages. If anything, he owes us the deposit back, and he should be required to go to small claims court if he wants to somehow hold us responsible. Thoughts?

A: You will need to contact an attorney. The issue here, is when and how the damage occurred to the sprinkler system.
