Q: Is there a time limit as to when I can take a dentist to court for malpractice?

In 2010 I had oral surgery with the intent of receiving dental implants. I had all my top teeth removed, as well as all but eight on the bottom. I paid $39,000 for the implants, but never got them. The anchor's fell out of my gums and the dentist kept putting them back in. I was in so much pain. Also the temporary plate I was given to use until my permanent one was finished kept breaking. Finally the dentist told me I had to settle with dentures because my body was "rejecting" the implants. I had to pay an additional $400 for the dentures. As for the anchors that didn't fall out, the dentist removed. All but one. This particular implant turned horizontal and migrated up into my sinus cavity. When a different dentist tried to remove it, she realized it was beyond reach...it was past my sinus membrane. So I was told to go to an Ear, Nose, and Throat doctor, at my expense. And for the past year I suffer from migraines that knock me off my feet. I was never reimbursed. Help!

A: Generally it's three years though it depends on the circumstances when there is contrinuing care.Suggest you immediately contact a member of the NJ Assn for Justice who handles medical cases--they give free consultations.You may have a possible contract claim or breach of warranty which have longer statutes.
