Santa Clara, CA asked in Immigration Law and Adoption for California

Q: Twice I have been given misinformation by the uscis and now am out around $2000. Is there any recourse?

I am an American citizen who lives in Brazil and have been attempting to get US citizenship for my adopted son here in Brazil. The first attempt they told me to file the wrong form. I have at least 10 e-mails showing this. After discovering that it was the wrong form I contacted them and was told that I needed file another, a different one. I requested that the money paid for the wrong process based on their directions be applied to the new process only to be informed that they do not refund money. Fast forward to today. I made an international flight from Brazil for the interview without him as I was also informed through their phone service that I could go without him if I had a letter from his doctor explaining why (he is a special needs child with mental issues that cannot endure a 28 hour trip). And once again I was informed that what I was told by someone who works for them was wrong. We were denied. Help! We are missionaries in Brazil on a tight budget.

A: You should contact a member of AILA ideally in the area of the US to which you will be returning. Religious groups working on immigration issues may have volunteer attorneys--consilt Jesuit Refugee, Episcopal Refugees, HIAS Refugees.
