Q: Ex-husband applied to become administrator to his mother's estate, who died intestate. Ex-husband owes substantial

amount of spousal support from family law - valid signed order in place. He has a probate hearing on 7/28/16 to determine if he will become the administrator. Notice of hearing to order collection is on 8/30/16 in family law court. When do I serve ex-husband with the order? Before the probate hearing or after?

A: The administrator of an estate is the person who is the personal representative of the estate. The assets of the estate and separate from the assets of the administrator. The appointment as administrator has nothing to do with what money the administrator owes.
