Port Saint Lucie, FL asked in Family Law and Child Custody for Florida

Q: how do I get an ex parte termination of parental rights?

Childs father molested her last year. DCF investigated and had positive findings. Cpt interviewed child and had positive findings. Police in Florida could do nothing because abuse happened in al. All police did nothing because he refused to come in for an interview and they said that was required. So no arrest. I filed a modification of custody, and mailed papers to al for him to be served and they were unsuccessful with service. Then the police in al lost my papers somehow. So I now longer have the originals. I currently have an ex parte order suspending time sharing, but it says it's good until the investigation is over and by further order of the court. There is no longer an investigation. And this was granted three months ago. The child's father is also extremely insane. (Schizophrenic) how do I go about getting his rights removed if we are unable to get him served? Since we know where he lives, the clerk says we can't serve by publication.

A: If the Alabama police lost the papers, get the clerk of court to provide you with more copies and then get them to serve the father.
