Bradenton, FL asked in Real Estate Law for Florida

Q: my husband left me his share of a vacation home in RI. His 2 daughter's each have a share. I want to sell, they don't.

I have an attorney whom seems to be very pokey at getting me on the Title. He's been charging me for things that are minute. This is been going on for four months. He gave me a form that says, "Certificate of Appointment", and reads, " I have qualified to be Executor on the Estate". But it doesn't say of what estate. I don't trust him or the attorney that's handling my other estate in a different estate. They have accumulated hours between the two of them and have charged me over the same things. I don't have anything that says I am the owner of RI estate. Or the condo where we lived which he left in my name only. These attorneys were suppose to work on each estate separately, but I think they're working on emptying my bank account. I get very little information from these attorneys and just a few pieces of paperwork. I sent them an email to start to actively keep me in the process of everything they do for me. And to cc me on all documents. Should I get a copy of my files from them?

A: If you are a co-owner of real property and two other co-owners want to sell, they can. They can file a lawsuit for "partition" which would in effect force a sale. If you want to keep your interest in the property you will have to be able to buy them out.

The rest of your post seems to be a diatribe against your attorneys. If you are dissatisfied with their work, consider hiring a different attorney.
