Q: Are we required to offer a 30 day notice after receiving a non-renewal notice?

Lease expires August 4. We have already signed a lease on a new property. Current landlord expects us to pay month-to-month because we did not submit a 30 notice to vacate. The non-renewal noticed demanded we release the property at the end of the lease. We agreed. Are they on drugs?

A: Review your lease agreement for the details. As a general rule, tenants are not required to provide notice of non-renewal UNLESS the lease agreement requires notice. You are correct that the landlord is taking two inconsistent positions--if you vacate per a landlord request, a tenant should not pay rent for a month after vacation OR you pay rent for one more month and the vacate notice is nullity.
