Miami, FL asked in Real Estate Law for Florida

Q: Rent to own nightmare..... Please read

I have been living in a house on a rent to own basis, which really wasn't a rent to own, as none of the money I paid went towards the purchase. The term has expired and now they are raising the cost 30k. We are in process of securing a mortgage but am wondering do I have any legal ground to prevent them from raising the price? Or even securing the house until I get the mortgage. I feel this company may not be completely on the up and up and when I first moved in I received a foreclosure notice and there have been other things that don't add up. Can someone help me or at least talk to me about this?

A: Without a written contract, no. Any verbal agreement for the sale of land is void per the FL statute of frauds and you dont meet the exceptions if no money went to the purchase price. I would go find another house to buy frankly if they seem shady.
