Q: Can a get a domestic if a friends child said I grabbed there neck if I did not live there

I was sleeping and woke up to there uncle pushing me saying he was going to choke me out. I called the law and from not living there didn't know the address so told them to trace it. I walked down the road to wait, when the officer got there he arrested me for domestic violence. I'm in no relationship with the mother, the children are not mine. I was staying about a month from my hometown just to help get sober and woke up to all this. How can It be considered domestic violence if I didn't do it and woke up to it and them just being friends no relation at all with anyone no relationship with anyone at all I was just babysitting

A: You're really asking the wrong question. You may be correct that you are not legally a "family or household member" but the prosecutor will just amend the charge to assault. You need to get an attorney.
