Asked in Contracts and Landlord - Tenant for Colorado

Q: My fiance & I rented a mobilehome w/the owners without a contract or written one and this place is UN-Livable!!

To the point were we've killed about 8 mices a day. Homes installation is falling out the ceiling. Leaks about 4 in the ceilings. We replaced the refrigator cause it was broken. Mice was living in it. The verments everywhere. Unsanitary Feces. No A/C or heating. And as bad as the mices, the Mold. It's ridiculous and they haven't bothered doing anything for 7 months now. Can we do something about this. I'm really concerned about this.

A: It appears that you have a claim for constructive eviction due to an uninhabitable rental. You can seek a court action to leave or self-fix the problem. If you only have an oral agreement default state rules apply, so you may want to consider simply terminating the lease (with proper notice). You may need to contact a lawyer for assistance.
