Lomita, CA asked in Landlord - Tenant for California

Q: Can a landlord raise the rent before our move in date and after we have already paid deposits and signed agreement ?

Hello, I have a question regarding a Rent or Lease agreement that me and my husband made with a property owner. We agreed and signed an agreement of a deposit of 1450 that we made in July and move in date with rent of 1450 on August 15,2016. Today August 9 we receive a phone call from manager stating that the landlord thinks that we are paying to little for the apartment so decides to raise the rent to 1600 a month. We have already put in a notice to our current landlord for us to move out by the 15 so we can move in to this new location but now with them raising the rent we can't afford that. Are they able to do that or are the breaking there own lease? What can I do ?

A: If you signed a lease for the stated amount, the parties are bound by the lease's terms; otherwise the breaching party may be sued for breach of contract.
