Q: Do I have a case for lost property or damages for my boat being sunk and therefore destroyed against the Marina ?

I had rented the same boat slip for 3 years. The owners of the slip moved my boat without notification or permission so that they could move their son's boat into my spot. Shortly after they notified me by email that my boat was taking on water due to the heavy rains, I drove down to check out the situation.I could not locate the whereabouts. I went to the owners house to inquire, and was told it was moved to an obscure out of the way place, and then discovered it was completely submerged. The owners promised to help pull it up, but delayed for the next 5 days until it was a hopeless loss.I was unable to determine the exact cause, but the boat was not plugged into the electric port which probably caused the bildge pump to fail

A: It certainly looks like you may have a valid claim, especially if it can be proven that the boat was not plugged in and that caused the boat to submerge. You should, of course, review the agreement between you and the marina. Do you or the marina have insurance?
