Asked in Landlord - Tenant for California

Q: Is it legal for a leasing agent of apartment complex to spy, harass, and single me out as a tenant, for personal reason

My girlfriend is friends with maintenance supervisors ex wife, maintenance supervisor. And leasing agent are involved, but he threatens his ex wife constantly, she is scared to be at her apartment alone, so we let sleep on the couch for a few days, in that time, he has deflated her tires, the leading agent has given 3 notices that there's too many ppl in my 2 bedroom apartment, like they r spying, harassing and singling us out, I can't afford to move, we are not loud, go to work every day, with constant threats of eviction. We havent done anything wrong. Now she is going to her apartment with her kids and he has already told her he will see her tomorrow. Police won't do anything at this point, what can we do to fight back , leave us alone.

A: Your girlfriend's friend has a problem with her exhusband??? The only real problem you have is that you must conform to the terms of the rental agreement you have with your landlord. S/her put the limit on number of occupants for a reason. You agreed to those terms. If you do not, you can be evicted. So you have to choose: continue to permit your girlfriend's friend to sleep on your couch and be evicted, or tell her she has to find another solution. It might be a good idea for her to talk to an attorney, probably a criminal defense attorney, about her situation.
