Bakersfield, CA asked in Contracts and Consumer Law for California

Q: I got into a 5-year subscription with a scamming magazine company that won't let me cancel? What can I do to get out?

It started at around May. I got a phone call from this woman who told me that I was selected and I won a free tablet (It's because I participated in the Publisher Clearing House sweepstakes). I got excited cause I never won anything. She told me that in order to get my tablet I got to have a subscription for some magazine for only $50 which I think that's reasonable. I accept, gave them my info and she told me that I am going to get a letter from the mail to fill out in order to get my tablet and when i get that letter I'll have 3 days if i want to cancel the subscription which is reasonable. I got the letter 2 weeks later and I decided I didn't want it after all because I could use the money for bills. I called them up and told them i decided i didn't want it; I was talking to a man at the time. He understands and said he'll take care of it. After that a few days ago I got a call from them again saying I owe 3 months of the subscription that I wanted to get out of.

A: Very important question: You say, "I accept". Did you give them $50.00? If so, you are asking for your money back. You can complain on Yelp or some other complaint website site. However, I have a suspicion that you have been had! Remember the old saying, "If it looks too good to be true, it is too good to be true!" If you did not send them any money, just forget it, and be grateful you did not sent them any money.
