Alliance, OH asked in Animal / Dog Law for Ohio

Q: How do I get justice for my dog?

My dog was shot and killed by an police officer when entering my home while serving a knock and announce warrant. He did not bark, growl, or show any aggression. The police opened the back door to my house and announced themselves and that they had a warrant. My dog went to see who was coming in the house, he was shot on sight 3 times. The officers came into my living room and handcuffed everybody there. I asked 3 times what the warrant was for and was told to shut up and do what they told me. They eventually told me they had a search warrant for my two sons for selling marijuana out of my house. When I asked them why they killed my dog because he didnt even bark at them, I was told they didnt need a reason, they have a shoot on sight policy concerning dogs(which the chief of police says is not true, that this was "a rare occurence"). They refused to show me the warrant. They refused to tell me the officer that killed my dog. As they were leaving they handed me the warrant.

A: First and foremost, did they find any drugs? Second, have you thought about getting a lawyer for your sons? The police don't exactly give up just because they come up empty on a search. Third, you may be able to sue the city for the loss of your dog. Someone would have to research the relevant policies, and compare them with policies and case law from elsewhere to determine if you have a viable case on that. You should be aware, before you pay for such things, that it may be difficult to put a large enough dollar figure on the loss to justify the expense.
