Q: Can I be denied a house rental as a sublease after 9 months of 1 yr lease agreement as a sublessee / roomate ?

3months into a 1yr lease agreement friend lost job & didnt want to be sued he moved out of state.He had verbal permission by mngr to i guess sublease to me.I am referred to as 'roomate' by mngr although FROM DAY 1 THEY KNEW HE WAS NOT RETURNING to live here & never lived w/ me ever.Its been 9months now all utillities in my name kids in private school. I PAY ALL RENT in my name .TALK to mngr all the time but NEVER met.8 Months AGO I ASKED mngr to add me to lease or allow lease assignment .she refused. Now original lease signed by friend ends in 2 wks.I AM told I NEED TO APPLY credit/backround check etc to see if Im APPROVED &can get new lease in my name?IS this legal can I be denied rental now after they never cared to meet me,run backround or anything else?ive been here 9 months now ?I dont have eviction or anything but had identity theft and not so great credit nothing major but really no established credit.Money wise im fine I put lot of love & $ into this Home can they deny me now?

A: You moved in without a written rental agreement with anyone. You have paid rent for 9 months or so, presumably to the landlord. You are basically on a month-to-month basis. If you were to rent anywhere else, I am sure you, like any other otential tenant, would have to complete an application and supply financial information and references. The fact that those steps had never been undertaken before does not changethe fact that such requirements are normal.

So if you wish to stay there, you need to comply with the landlord's requirements.
