Jersey City, NJ asked in Real Estate Law and Landlord - Tenant for New Jersey

Q: Are we living in a non-habitable building?

My wife and I moved into a multiple unit dwelling that was under renovations when we initially viewed the apartment. Within a few days of moving we noticed several problems with the dwelling with legitimate concern as they had been promised to be fixed by the management company overseeing the problem. In our lease, we were provided 7 days upon move in to state discrepancies which my wife did. Mangement overreacted severely and refused to deal and only acknowledged my communications though they admitted she was right.

Ever since they have been very negligent about repairs in the building, they are as following:

Large holes in the walls in the lobby area

Roaches in the alley (poorly treated after complaint are now moving inside)

Grouting on brand new floor tiles are breaking

"Re-porcelined" bath tub actually just coated in white paint which is now coming off and sticking to soaps

Roofing tile on the side of the house

Multiple calls to fix toilet which is frequently running

A: You need to retain counsel to represent you in this matter. I have dealt with many similar situations in Jersey City, so unfortunately you are not telling me anything I have not seen far too often. Do not try to handle this yourself. Good luck.
