Q: If a lease does not get renewed, does it automatically renew for another year at the same rate?

My property management company wanted to raise the rent $70. I was negotiating with them on this, but they never returned my calls and on Sept 1 (the date my lease was up) I received my rental slip with no increase. I assumed that they didn't increase it, but then I got a letter saying I had to sign the new lease with higher rent rate, or vacate. It's odd, because I got my October slip, and it's at the old rate. Do I have any rights here? I've been in this apartment for 5 years, it's rent stabilized, but they have the market rate at an exorbitant amount and give me a "preferential" lower rate, which is what apartments cost in my neighborhood in queens.

A: Depends on the lease language, but generally after the term ends it converts to a month to month tenancy at the same rate of the lease. Rent stabilized or rent controlled apartments are a whole different ball of wax with extensive rules and regulations that would need to be reviewed for a more complete and accurate answer to your question.
