New Rochelle, NY asked in Landlord - Tenant for New York

Q: Time frame to look for another apartment.

I have been living with my daughter for the past 5 years. I have been paying her cash for utilities, etc. she wants to rent the top floor where I live and I currently don't have a place to go. she wants me out next week. can she force me out without giving me sufficient time to look for another place?

A: No. She would have to evict you in court. Time frame depends on where you live.

A: Typically squatters, individuals without a formal lease, still have 30 days if they can show that they have been living their on consent of the landlord. The other attorney is correct that to forcefully remove you an eviction proceeding would have to take place, which does depend on where you live.
