New Lenox, IL asked in Family Law, Child Custody and Child Support for Illinois

Q: Third Party Custody/Visitation/Financial Reimbursement? Raised nephew for 7 years. Now birth mother took him.

No father on birth cert. Birth mother in and out of life...more like an aunt. Well documented. Now that she's marrying bf (of 5 years)....and she puts nephew in school/daycare the majority of the time....she took my nephew. I don't have any legal rights. I tried, but it was never clear what would happen in court...and I don't want to destroy our family (for the kid's sake). Seems I let them get a foot in the door to get involved....and they have wedged me out. Is there anyway to get custody (where I would not keep them from his life) or shared custody or visitation? Or is it possible to get child support / pay for the last seven years (of almost non-stop care)? I paid for food, clothes, toys, 3 years of school (over $5000), activities, etc. They think my pay was that they let me keep my nephew all the time.

A: You mm ay have no right to the parental rights you are seeking, since the child is now in the physical possession of a parent. I suggest you discuss this with an attorney.
