Bothell, WA asked in Criminal Law and Personal Injury for Washington

Q: My 19 year old friend pushed a 17 yr old that wouldn't leave and the 19yr old got jumped. Who is in the wrong?

The 17 year old and 6 other friends that came to the house stole something and were asked to leave multiple times because they were uninvited . 6 ppl from that group ended up jumping that 19 year old and cracking a Vase over his head and stomping him out. He went to the hospital with multiple head abrasions, cuts, and bruises. Is that 19 year old in the wrong for pushing the 17 year old? And could the 19 year old press charges and have a liable case?

A: Better to get his bills paid through the victim compensation act if there is one in your state. He should make sure he is covered under medical assistance so he doesn't wind up with bills.

He is technically at fault for shoving someone.Touching them in that way is technically a "battery"

They on the other hand are up for assault and other charges.

Civil liability doesn't make sense because if they don't have money all that would get him is aggravation and a piece of paper saying they owe him which he won't collect on. He should get a consult with a criminal attorney as he could be charged. Neither of you should discuss the facts on social media, any website--it's a place prosecutors look.
