Underwood, IN asked in Criminal Law for Indiana

Q: People stated to the police that my so brought pot to a house. He is 17 and the police said they will

Be sending the statements to probation. Probation gets to make the choice if they want to charge him. The police said between statements and suspicion they have enough evidence to send it to probation.

How is this possible with him not being arrested or charged?

He is 17, can they wait till he's 18 to doing anything to him?

A: In Indiana most juvenile cases are referred to probation first. Probation will review and call you and your son in to the office. They may do what is called an "informal adjustment" which means do what they ask and stay out of trouble. Or they may send to the prosecutor to have him/her review and file charges in the juvenile court.
