Islamorada, FL asked in Probate for Florida

Q: The executor of a will hasn't paid the beneficiaries 1year later. She has the money. What legal recourse do we have?

My dad passed away and left his wife a large sum of money and willed his children smaller sums. She is the executor of his will. She has, thus far, refused to pay the beneficiaries their share of the according to my dad's will. What can we do to cause a judge to compel her to do what she is supposed to or be jailed? This would close the estate case.

A: There may be reasons that she has not closed the estate yet. If she won't tell you what those reasons may be, you can schedule a hearing with the judge. You also should think about asking that she post a bond to secure the performance of her duties as personal representative.
