Q: How do I go about obtaining court documents that have been expunged? I need to disclose all arrests made. Thank you.

Hello, I am currently filling out an application from the Marijuana Enforcement Division and they want me to disclose all arrests. In 2010 I was arrested for a small amount of marijuana and the record was eventually expunged. I was wondering if I have to disclose this arrest, and if so how to get copies of the court records? This happened in Reading, Pennsylvania.

A: Usually expunged records can still be found by law enforcement agencies. For most law enforcement positions, you are required to state all arrests including expunged, non-referred (i.e. no charges), etc. You can check with the employer for details.

As for getting the records, try calling the courthouse in Pennsylvania (every jurisdiction has their own procedures for requesting documents). Make sure to mention that you are requesting the material on yourself.
