Knoxville, TN asked in Child Support and Divorce for Tennessee

Q: Is it easy to get a 60.02 opened after two and half years of divorce? I think my ex hid funds. I have no proof. Thanks.

I want to open my divorce. It's been two and half years. The grounds would be fraud. My ex may have assets that were not shared at the time of the divorce. I have no proof and my ex says that they were 100% forthcoming and has no hidden wealth. Well. I'm not happy with the way the divorce went. I signed off on everything and I'm now in arrears in child support, over $10,000. So my ex wants fair child support and I now I'm threatening to open a 60.02. Is this justified?

A: You have no grounds to open the divorce or ask for relief from judgment. You would have to prove you are entitled to relief by clear and convincing evidence. Unless you have some real good evidence of fraud, you would not succeed.
