Asked in Family Law for Colorado

Q: Have been kinship provider with Final Orders Hearing in two days. Can I ask for visitation and express concerns?

Grandson had been in my care for 16 months since birth. Grandchildren had been taken away from parents because mother and newborn tested positive for meth. Mother has been non-compliant since day one, father has completed the bare requirements. Upon reunification, the father and children will be living in the same household as the mother. Is this not putting the kids in harms way?

A: Yes, you can for both visitation and concerns. Be aware that for an expedited case (due to the age of the child) the judge must either return the child to the compliant parent or grant guardianship to you at the FO hearing (i.e. a 3 to 6 mo. extension is not normally an option). The weight of your requests will be heavily dependent on the GAL and social worker's opinion...
