Thousand Oaks, CA asked in Employment Discrimination for California

Q: Can i get unemployment if i get layed off because of daca expired but have been approved for renewal?

Basically i am not able to work because my new card didn't come soon enough. I got the letter saying I've been approved for renewal of my card. I can't work with just the letter. Can i file for unemployment with just the approval letter? I checked and since I'm technically not able to work i am not qualified for unemployment. But is there some way to convince them to ignore the technicality and if yes how would i go about doing it?

I've been working 40 hours every week since deferred status was granted.

A: As far as I know, there are no exceptions to that rule. You were laid off because you're no longer eligible to work. Eligibility to work is the key, not the mere ability to work.
