Frederick, MD asked in Criminal Law for Pennsylvania

Q: If an officer who found marijuana on me tells me I Should receive a disorderly conduct summary offense then will I

A police officer pulled me over because I matched a description of a criminal, but then he told me my car smelt like marijuana. I told him where it was and he said that I will most likely be receiving a disorderly conduct citation in the mail as I have no prior drug offense and I have never been arrested and finger printed or anything before. He did not arrest me or have me sign an piece of paper or anything. He simply took down my address and let me go after saying most first time drug offenders receive a summary offense instead of a drug charge which would cause me to lose federal aid for college. I was wondering if I should take this police officer's word that I will receive a disorderly conduct citation and the likelyhood of receiving it and not a possession charge.

A: Do you have a choice?? I mean it seems the play at this point is wait for either a citation or a criminal complaint in the mail. The officer is right, many first offense marijuana cases work out to summaries, but he has bosses too. If your future is important to you, at some point you should hire an attorney. They will be able to steer you and perhaps even get you a better result than a summary.
