Oregon, WI asked in Child Custody and Family Law for Tennessee

Q: An un-wed couple in TN have a child 1yr ago, the father signed the Birth Certificate but nothing else has been done

They breakup and the Mother moves to another state. The father files a neglected child report and a few weeks later files an ex-parte restraining order and injunction with false claims the mother absconded, missed child Dr. appt.

He also claims that he fears she may be around her biological father who was just released from jail and is a registered sex offender living in the same state even though she has not had contact with him since she was 3 (20yrs).

The ex-parte says she needs to return the child to TN and give him immediate possession until a court date is set.

Can this work?

A: Yes, it could work. That is why you need to retain the services of a local seasoned family law attorney. There seems to be several things operating that are not clear in your question. First, there is a statute governing relocating with a child to another state. Second, a determination must be made as to who the real legal father is. In your question you indicate that the biological father of your one year old child is a recently released convict who is must register as a sex offender, however, for the time being, the father who signed the birth certificate is the legal father. This is very important. I am not sure what part of Tennessee you are in, however, you need to consult a local seasoned family law attorney to defend you.
