Q: Liability for accident while turning left on a red light.

I was in an accident in Nov where I was turning left to clear an intersection on a red light and was hit head-on by a driver who ran the red light. His insurance is claiming they have no liability, my insurance is fighting it but still says I will probably have 50% liability. How can I have equal liability while I broke no laws and the other driver did? This will probably go to arbitration so it definitely not settled but I am confused by this.

A: First no one takes anybody's word. Big question is what do neutral witnesses say. And for insurance companies how police report is written.

Understand in general vehicle turning left must yield to oncoming traffic.

Why not contact a member of the Okla. Assn for Justice? They give free consults.

Were there any cameras showing the intersection? Likely even if they were the images are gone but.....

Hopefully you have photos of the cars which may help establish who had position on whom.
