Q: lawyer worked a total of 8 hours before being dismissed for not filing paper work correctly can they still collect 25%?

Lawyer was dismissed after repeatedly informing claimant on Workers Compensation that they would file paperwork correctly. After 2 months, being asked numerous times ( They Filed the Paperwork with no injury listed ) I released them, this was after numerous attempts of trying to contact them. I sent emails, that were never answered, left numerous messages, and never got a phone call back, and sent numerous text messages to their cell phones and never got an answer. At this time I decided to release them as the Attorneys of Record. Can they legally collect the 25% if I win this award with the assistance of the Office of the Injured Employee assisting me. How can I go about getting a waiver of Attorneys Fees from them. I have contacted them on two different occasions via email and message and have not received an answer from their firm. I don't want to keep trying to contact them for fear of them making it seem as if I am trying to harass Typical of their practice. Please help.

A: They can collect up to 25% a week for the time (8 hours) approved by DWC but the amount is limited by the actual time expended and approved working on your case. Previously the hourly rate was $150 per hour but that amount has been increased. You could send the lawyer a certified letter and request they waive the fee if you feel they did not assist you.
