Southwest Brevard Cnty, FL asked in Real Estate Law for Florida

Q: Can my grandmother remove me from our condo deed in Florida?

Last year my grandmother added me to the deed of our condo, but now she is threatening to remove me. The deed is as followed: The Special Warranty Deed made this, August 16th 2016, between (name) a single women who's post office address is , ------------------ individually and as trustee(s) of the (grabdmothers name) declaration of trust DTD October 20th, 2010 ("grantor" ) , and (Grandmothers name), a single women (my name) a single women as joint tenants with the rights of survivorship (who's address is the same as the deed condo). Can she remove me from the deed and kick me and my bf out?

A: No, she can't. the deed names her and you (the quoted language, if accurate, is somewhat confusing, because it refers to "a single women (sic)" twice, but definitely creates a JTWROS. The dead could only be defeated were she to sue to cancel the deed, survive you (i.e.: remain living after you had died), or join with you in executing a subsequent deed.
