Q: If I go to court and I agree to pay any rent I owe, will I still be evicted?

I have spoken to my landlord and she said that if I had what I owe the day before court that she would drop the case. However, I will only have a part of what I owe. I am willing to pay everything that I owe, I am just nervous that if I go to court, I will not have any choice but to be evicted and I will still have to leave even if I give her the rest of the money.

A: If she accepts any rent money from you after filing the eviction action, the court will probably dismiss her eviction complaint, but ONLY if you get a written receipt of payment that she signs indicating the date she signs and the amount you are paying. But she does not have to accept anything from you. She can insist on payment in full, and if you don't pay in full, then she can proceed with the eviction.
