Q: Required to pay c.s. if mom told judge she took care of child, but does not take care of child?

Mom told judge she provided daily care of child she has custody of. Yet she gave child to her parents to take care of and moved to another state. I have only made $150 worth of payments. She lied to court and judge about caring for child. Cant the court hold her responsible for fraudulent statements? I ask because if the c.s. amount to be paid is based on income, shouldn't it be calculated by the persons who are actually taking care of child? She needs to be held responsible for statements to court.

A: You must pay the court ordered amount until the court changes the amount. To change that, you must file for a change with the court based on changed circumstances. You might also ask for a change in custody since mother abandoned the child. Use the Find a Lawyer tab to find a local attorney to consult.
