Englewood, FL asked in Civil Litigation, Contracts, Employment Discrimination and Employment Law for Florida

Q: Has my employer violated my rights and/or the 4th amendment, and is this punishable in a court of law?

I'm an employee who was forced to submit blood for a "random" drug screen after 2 urine samples were deemed "diluted". I suffer with chronic U.T.I.s so I consume plenty of hydration. Their policy states clearly that after 2 diluted urine samples the employee is deemed cleared and to cease further samples. I did not know this at the time and was trying to cooperate, even though I felt that this was excessive. I went along with it so as to not be immediately terminated as the form states. I have the policy now and the 3 "random" drug screen forms used. I think they violated their own policy and have infringed on my 4th amendment rights. I also feel harassed. To make matters worse they used iodine to clean my skin (to which I have a documented allergy) and now my entire arm aches. They sent me right back to work involving patient care immediately following the blood draw.

A: I am not able to answer your question as I do not handle employment law types of cases. However, I suggest that you use the Justia find a lawyer tool to locate an employment law attorney in or near the Englewood, Florida area. It would be worth getting a consultation with a lawyer on the issue.
