Q: Do I have a right as a personal representative of my brothers estate to examine POD documents?
My brother died last September in Florida and since he had no will, I've been appointed Personal Representative of his estate. He had an IRA of almost $5000,000 and the Oppenheimer brokerage said it was a POD account. Does the estate have a right to examine the document?
A: No doubt you can engage in formal discovery, if necessary to examine all pertinent documents. If you think the IRA amounted to $1/2 million, you will no doubt be able to find an attorney able to assist you.
