Q: Got a dwi in NC, 1ST ever blew .14 what are chances of getting reckless driving instead of dwi? Can I make a plea to DA?

I have a PA license, was visiting NC and got pulled over for speeding. Am not a resident there. Looks like I will be getting a level 5 charge but want to push to have it reduced to reckless driving. How do I make a plea to the DA. I've never been in trouble before and am active duty military. I also work in Virginia. Lawyer is recommending that I get a VA license if I do this my license won't get suspended if NC decides to suspend my license.

A: No District Attorney I know of will reduce a DWI absent some serious defect in their case. So if everything was done properly, generally speaking, your options are trial or plead guilty and at a .14 your odds of winning at a trial are less than slim and none. As to getting a VA license - if you are convicted, you will likely still get suspended there as well because VA, NC and PA all share traffic info and the record of your civil revocation of your PA license will likely be noted if you attempt to get a VA license.
