Des Plaines, IL asked in Child Custody and Divorce for Illinois

Q: I am divorced as of Dec. 2016. My ex was put into comtempt because he did not pay the lawyer as the MSA said

there were about 8 more items from the MSA that he violated. He got mad at me and decided the subpeona my bank account because he claims he did not know about an individual account that I had. He did. Over the course of 2016, the most I had in there was 8500.00 in June. I took the money out and bought things for my kids, and paid some bills. When I filed in August I had only 57.00. In October my account had 1300 and I took it out to go Christmas shopping. Now he is saying he did not know about it and saying I did not disclose it. His lawyer wants him to motion for vacatur. My attorney want Motion to Quash. I am afraid! He still owes me about 30K, plus is late on paying my mainteneance for February and January and February health and school deductibles. I am scared he will want to change the parenting allocation and take the kids more from me-which is my worst fear. What will happen and what do I do?

A: It is not proper to answer your question because you already have an attorney. In addition, he or she knows much, much more about your situation than can be expressed in this forum. This makes any answer that you might get here to be incomplete and pure guesswork.

However, and for your general peace of mind, please know that it is not easy to modify parenting time if one party does not agree to it.
