Q: If im stop and blow .08 with DWI this is my 3rd one in north carolina what are my chances of beating it

They said i did not stop for a license check and i turned the opposite direction but they was on the left and i was coming off a back and was going right so i did not know i was suppose to stop and they came behind me and pulled me over and i blowed .08 , so i would like to know what are my chances of beating this or what are my options

A: If this is your 3rd DWI - you probably shouldn't beat it. Something needs to happen to you to properly impress upon you the fact that you ought not drive while impaired before you end up killing someone. .08 is right on the limit, so it is possible to be convicted on the blow result alone but you never know what will happen at trial. It is also possible you could be found not guilty. However, based only on the information you have provided of two prior DWI's and being stopped for avoiding a check point - I would put your odds of beating this charge at less than 25% and that's with a good DWI attorney in your area.
