Q: I have been married for 12 years all in nc, we have 2 kids together and I have one before marriage. 2 are 8 and 9 years

old, he wants to file for divorce. He has the mortgage in his name but I am on the deed. We have lived in same house the whole time. He pays mortgage and I pay utilities and food and for my own car. Can he force us out of the house? He says he will sell it, can he do that without me signing? Or he says I will have to take over the mortgage and house in my name, but my credit is not good enough to do that. I don't know what to do. I can't afford an attorney for this divorce I don't think?

A: He can file a divorce from bed and board to attempt to force you out of the house. However, on the facts as you say they are, likely no attorney would advise him to do that or he would more likely be the one actually required to move out.
