Cape Coral, FL asked in Libel & Slander, Personal Injury and Real Estate Law for Florida

Q: I have had two forms of gas entering my home as a result of HOA action/neglect. What are my rights?

The first unresolved form of gas exposure is from chronic exposure to H2S gas emitted by an old underground irrigation system that have been making us ill for 3+yrs. The odor is so strong none of the bedrooms are usable on irrigation nights. The second form of gas exposure was caused when the HOA went our roof without consent to put screening components over sewer exhaust vents. Their work left the sewer exhaust vent 90% blocked and caused methane sewer gas to re-enter our home through the HVAC system for 2months. Each exposure resulted in multiple adverse health events and effects that were not pre-existing including seizures, drop attacks, hypoxia, respiratory arrest, cardiac events, transient vision loss, etc. Every attempt to report these issues to Management/BOD has been met by the board President with verbal abuse, intimidation, denial, and outrageous accusations of us lying or trying to cause trouble or cost to the association.
