Q: The other day I got into an accident and rear-ended a lady and I ended up getting a speeding ticket

I was not speeding during the accident I just pressed the break too slow. Can the officer give me a speeding ticket without witnessing me speeding?

A: Yup, because it's presumed you were driving at a speed that would not allow you to stop within the assured clear distance ahead. Your defense is not going to be "I didn't get the distance right" or "I wasn't looking." Possible to defend but you want to talk to a lawyer. Ideally it can get dropped to a non-point. Photos may help if damage minimal.
