Q: In a child abandonment case under what grounds can a ga warrant be recalled.

Fulton County. A Motion to Recall the Warrant had been submitted. I did find a blank form for which reasons were listed and unchecked. Of course the party wants to avoid the repercussions of the warrant, and to get a court date scheduled. Just had never heard of such before. Curious if the fact the defendent moved or if the plea was a reason for the Motion to recall the child abandonment warrant.

A: Typically, recalling warrants does not occur. The Prosecutor, in such cases, is suspicious of trying to "undo" any child abandonment charges, because they know that pressure to protect the family "unit" (when the breadwinner may be going to jail) causes people to change their story.

Hire and attorney, or get an appointed lawyer, or public defender to help navigate this.
