Q: Can I have a 2003 Misdemeanor Class A Public Lewdness conviction expunged? I was never accused of such prior or since.

I was convicted and sentenced to probation and a fine, they ended up revoking my probation as they ordered group therapy for sexual deviation after 12 months I could no longer with stand the therapist, I asked to see some one else and was refused, I told them to put me in jail I was not going back to him, they revoked had me pay remaining fee's and fines and closed the case. It has been 14 years and not even an accusation of such, but it is limiting me from obtaining some employment positions. I still maintain my innocence but I need to see if I have any options.

A: Convictions can not be expunged unless they are overturned on appeal or pardoned by the Governor of Texas. The window to start an appeal closes 30 days after the date of conviction so pardon is your only hope. You can download the application and instructions from the web site of the Texas Board of Pardons and Paroles. Look for the forms under the "Clemency" heading.
