Q: If the initial renewal contract date starts two months from now and you have decided that you want to terminate your

Present lease and it's within the 60 day termination time frame for notification are you still bound by the upcoming lease. Also, if two people are on the renewal lease but only one signed is it still binding if you terminate your present lease and the renewal lease doesn't take effect until two months from now.

A: On your first question. If you are within the 60 day window to terminate the existing lease, you should be able to do so. Typically, such a termination is simply notifying the landlord that you do not intend to renew the lease.

On your second question. If one tenant has signed and delivered his or her signature to the landlord, it is possible that the landlord could attempt to hold that person to the lease. It would really depend upon the exact wording of the lease agreement. I suggest that you have a real estate attorney in your area take a look at the lease and give you some specific advise on it. (If the lease signed by one tenant has not been returned, then I believe that you can simply tear up the lease and give the notice of termination / notice of non-renewal.
