Q: A company in CA made a deal with Colombian factory for private label of generics for Middle East.Do I need a license?

We are a California based company in business of food supplement. We are negotiating a private label brand for generic hormone with FDA approved facility in Colombia to market it in the middle east area.( outside the USA). Do we need any permits or license to do that?

A: This is a rather sophisticated question. Almost every country in the Middle East has its own regulations governing the importation and sale of goods including food or vitamin supplements. You need to determine what certifications and licenses are required for the goods to be allowed into the country that you are shipping them. This will be different from country to country. A FDA certification will generally be accepted under various reciprocity agreements but as these are supplements they may or may not be as certain countries subscribe to different criteria that may not be the same as the FDA standard. As for a license, the party importing the goods will need to have the appropriate licenses to import as well as a license to sell or distribute the product.
