Burke, VA asked in Landlord - Tenant for Virginia

Q: Can attorney fees be assessed to late fees?

I am currently renting a townhouse and I have three late fees on my account for late rental payments. I was recently assessed attorney fees for the late fees and told I was going to be evicted for not paying the late fees. I spoke to a representative at the property management company who told me as long as the base rent was paid on time I could make payments on the fees however now I am being threatened with eviction. I received an e-mail stating my court date has been postponed however I have never received any documentation stating I was being taken to court.

A: The assessment of attorney's fees on any matter involved with the residential lease depends on what is stated in the lease. You should read your lease very carefully.
