Asked in Estate Planning for Florida

Q: How do I get the executor to answer my questions about my money?

He has not told us how much the home sold for or how much we will receive he just sends a check in the mail once a month. Sometimes late. What can i do? He curses at me when I ask simple questions.

A: I suggest that you try calling the Personal Representatives attorney or hire an attorney to represent you and have your attorney speak with the Personal Representatives attorney to get regular status updates. It might increase the cost of the estate but at least you should be better informed. (It is possible that the Personal Representatives attorney might not be willing to speak with you but it is worth a shot).

A: As you know, you have identified several serious problems. You may be best off contacting a probate attorney to get the answers that you rightly seek.

A: If you are having trouble getting information directly from the Personal Representative, you should contact the Personal Representative's attorney directly. The attorney for the Personal Representative has a fiduciary duty to you as a beneficiary to provide you with information about the estate. If, however, you do not get the information you are seeking from the attorney, then you should hire a probate attorney to represent you as a beneficiary.
