Q: How would one get a name of the at fault party for a wheelchair accident that occurred on business property?

A friend of mine was run over by a woman in her personal electric wheelchair while in Sam's. Sam's gave her an incident report but did not provide the name of the person who was at fault. My friend has been unable to secure legal representation thus far and needs the at fault parties' insurance information to file a claim with her own insurance company

A: Your friend can specify on the claim form that the name of the other party is unknown, noting the information you have given above. If Sam's Club does in fact have the information, your friend, your friend's attorney, or your friend's insurance company can "discover" the information from Sam's Club, using a subpoena or other discovery tool.
